Проведен комплексный анализ правового статуса грузополучателя в договоре перевозки груза, исследованы основные доктринальные подходы к определению его правового положения. Рассмотрены четыре основные концепции статуса грузополучателя: как лица, в пользу которого заключается договор; как самостоятельной стороны договора; как части единой стороны с грузоотправителем; как субъекта, совершающего одностороннюю сделку по принятию груза. Особое внимание уделено анализу прав и обязанностей грузополучателя, механизмам защиты его интересов в договорных отношениях. Обоснована необходимость законодательного закрепления правового статуса грузополучателя для устранения существующих правовых коллизий. Делается вывод о том, что грузополучатель не является стороной договора перевозки, но представляет интересы грузоотправителя и совершает одностороннюю сделку по приему груза. Предложены конкретные меры по совершенствованию правового регулирования статуса грузополучателя, включающие внесение изменений в действующее законодательство и уточнение механизмов защиты его прав.
Provides a comprehensive analysis of the legal status of the consignee in the contract of carriage, examines the main doctrinal approaches to determining its legal position. Four main concepts of the consignee's status are considered: as a person for whose benefit the contract is concluded; as an independent party to the contract; as part of a single party with the shipper; as a subject performing a unilateral transaction for the acceptance of cargo. Special attention is paid to the analysis of the rights and obligations of the consignee, mechanisms for protecting his interests in contractual relations. The necessity of legislative consolidation of the legal status of the consignee to eliminate existing legal conflicts is substantiated. Concludes that the consignee is not a party to the contract of carriage, but represents the interests of the shipper and performs a unilateral transaction for the acceptance of cargo. Specific measures are proposed to improve the legal regulation of the consignee's status, including amendments to current legislation and clarification of mechanisms for protecting his rights.
