The most urgent criminal law problems of criminal liability for fraud in the sphere of real estate turnover are comprehensively analyzed. The article examines the issues of qualification of criminal acts as theft or as acquisition of the right to other people's property, reveals the negative impact of qualification errors on the formation of uniform law enforcement practice in the field of legal relations under study. Based on the analysis of the economic significance of real estate objects and the justification of the obsolescence of the dimensional signs of damage, the need for legislative novelization is proved, including the introduction of a special corpus delicti in the Criminal Code of the Russian Federation.
