Abstract:
An approach to solving the problems of legality in obtaining and using digital images of information from hosting providers in the activities of the internal affairs bodies of the Russian Federation is proposed. Using the method of doctrinal interpretation of current legislation, as well as the study of judicial practice, the necessity of maintaining judicial control over access to digital images accumulated by hosting providers and containing personal data and information about private life is substantiated. The procedure for documenting operational investigative activities related to access to digital information images and a list of organizational and legal measures aimed at creating conditions for preserving the evidentiary value of digital operational information are proposed.
