Abstract:
The constitutional and legal mechanisms for the protection and protection of human rights, their relationship and functional differences are considered. The thesis is substantiated that the «protection» of rights is mainly preventive, regulatory and organizational activities of the state and society, while «protection» is restorative and jurisdictional activities implemented through judicial and quasi-judicial procedures. Key elements of the constitutional level of rights are analyzed: the catalog of rights and the principle of their direct action, institutional guarantees (constitutional control, ombudsman, independent court), standards for restricting rights (legitimate purpose, necessity, proportionality), as well as the role of international legal guidelines.
