The problems of declarative norms of the Constitution of the Russian Federation are comprehensively analyzed. The dialectical nature of the Basic Law is investigated, which, on the one hand, contains programmatic, constituent norms and principles, and on the other hand, sets a vector for the development of current legislation. Based on specific examples, such as the realization of the right to housing (in particular, the mechanism for providing housing for orphaned children) and the direct effect of the right not to incriminate oneself (art. 51 of the Constitution of the Russian Federation), demonstrates how constitutional prescriptions overcome declarativeness through detailed specification in federal legislation. It is concluded that the effectiveness of the implementation of constitutional norms directly depends on the degree of development of the legal mechanisms that ensure them, and the Constitution itself is not a static declaration, but a living guideline for the legislator, forming the basis for the entire national legal system.
