The article is devoted to the criminological analysis of convicted persons for crimes in the sphere of economic activity (Chapter 22 of the Criminal Code of the Russian Federation). The empirical basis of the study was made up of departmental statistical materials of the Judicial Department at the Supreme Court of the Russian Federation. The central conclusion of the study is that there is a systemically low proportion of convicts in the total number of persons brought to criminal responsibility (1.07‒1.92 % for 2018‒2024). At the same time, the chapter itself reveals the extreme unevenness of emerging law enforcement practice. It has been demonstrated that for a number of formulations (Art. 171.2, 171.4, 187 of the Criminal Code of the Russian Federation), the rates of convicted persons reach 75‒99 %, while for others (Articles 173.1, 186, 199 of the Criminal Code of the Russian Federation) remain critically low (4‒25 %). This contradiction indicates the selective nature of criminal prosecution and the objective difficulties in proving complex economic structures. It is concluded that official statistics do not reflect the actual level of criminalization of economic activity, but rather the priorities and opportunities of law enforcement practice. The insignificant absolute figures of convicts under Chapter 22 of the Criminal Code of the Russian Federation confirm the thesis that departmental optimization of criminal prosecution and problems of proof create artificial restrictions for an adequate assessment of the scale of economic crime.
