Abstract:
Is devoted to the study of the urgent problem of preventing publicly committed crimes aimed at encouraging a wide range of people to commit encroachments on the territorial integrity of the Russian Federation, related to clarifying the causes and conditions of such crimes, a complete understanding of which is one of the key prerequisites for improving the system of preventive measures in this area. This problem is considered taking into account its relationship with the criminological and criminal law features of crimes provided for in Art. 205.2, 280, 282 of the Criminal Code of the Russian Federation, and the shortcomings of the existing system of measures to prevent them. The purpose of the study is to develop theoretical concepts and gain new knowledge about the determinants of crimes that encourage others to commit illegal acts that infringe on the territorial integrity of the state. The achievement of this goal is ensured by solving the tasks set, which consist, in particular, in identifying and considering a set of determinants of such public acts, forming reasonable conclusions and proposals for improving the effectiveness of their prevention. Based on the results of the study, a general conclusion was drawn about the predominance of political, moral and psychological determinants of the commission of relevant public crimes, the minimization of which can be achieved through the development of general and individual preventive work.
