Abstract:
The study of the normative consolidation, the essence and significance of the general legal and special principles of insolvency (bankruptcy) of legal entities for the development of theoretical and practical results of optimization of this institution. The judgment is substantiated that in the system of interrelated principles of insolvency (bankruptcy) of legal entities it is necessary to identify special principles, including the independent principles of responsibility of a legal entity, the inadmissibility of opposition by holding structures to the implementation of insolvency (bankruptcy) procedures, etc. This scientific approach makes it possible to understand the essence, specifics, prospects and ways to optimize the studied insolvency (bankruptcy) procedures to the greatest extent. The situations where a peculiar «combination» of general legal and special principles takes place are characterized; so, for example, regarding the expediency of participation (or non-participation) in the implementation of bankruptcy prevention or clarification of the obligations of the relevant bank, the Deposit Insurance Agency is accepted in accordance with the principles of minimum use of the deposit insurance fund (in part of its funds) or other property of this structure, the necessary awareness of the financial situation of the relevant bank, (special principles), as well as principles of reasonableness and good faith (general legal principles).
