The problems of state (political) participation in the formation of the rule of law are considered. Using the example of the European supranational association (the European Union), the trends of the state's influence on the rule of law are analyzed at the level of its three foundations: formal-legal, purposeful and ideological-value. The conclusions characterizing the ambiguity of the results of political influence on the legal order in the state, which is clearly expressed in the political and legal practice of the European Union and its states, are formulated. Goal — to investigate trends in the practice of state participation in the formation of law and order. Elements of formal legal, historical, comparative legal, and systemic methodologies are applied. The socio-axiological approach to law served as the basis for the study of the substantive foundations of the European legal order. It is concluded that the trend towards politicization of the legal sphere is found today both at the supranational and national levels. The author believes that these trends lead to the loss of a significant part of national sovereignty by the EU member states, which is unlikely to have a positive impact on the development of the political process in the European region. The results of the study make some contribution to such areas of legal theory as the theory of legal order, legal axiology, and the theory of sovereignty.
