The article examines the issues of qualification of the privileged composition of the murder provided for in Article 107 of the Criminal Code of the Russian Federation. The content of the concepts "affect" and "strong emotional excitement" is considered. The author believes that the latter concept should be excluded from the content of Part 1 of Article 107 of the Criminal Code of the Russian Federation.
