PROBLEMS OF DETERMINING THE CONSEQUENCES OF A CRIME UNDER ART. 330.2 OF THE CRIMINAL CODE OF THE RUSSIAN FEDERATION

Abstract:
This article considers the problems of establishing the consequences of a crime under Art. 330.2 of the Criminal Code of the Russian Federation. The author comes to the conclusion that the indicated corpus delicti should be defined as material, denoting the consequences in the form of significant harm in the norm. It is proposed to attribute this article to the category of crimes of moderate gravity, setting out the sanction in a new edition, increasing the size of the punishment.
