The formation of the concept of the modern democratic regime is considered in connection with the theory of the legal state of the New and Modern times. The leading role of philosophical discourse in the theory of legal state, namely the ideas of representatives of the German classics, is noted. It is argued that the formation of the legal concept of the modern democratic regime was particularly influenced by the following principles: rule of law, justice, recognition of human rights and freedoms, separation of powers. In the second half of the XIX century due to the intensification of political processes and the development of political science, it became possible to distinguish between the political and legal concepts of the modern democratic regime, which have both similarities and differences.
