The theoretical and legal foundations of the constitutional rights and freedoms of the individual in the aspect of the theorization of their legal nature are being examined. The issues of the influence of subjective factors on social and political-legal institutions in the framework of the development of a democratic society are investigated. The concepts of the legal status of an individual are analyzed and their definition is proposed.
