The gap in the Code of Criminal Procedure of the Russian Federation is being considered related to the lack of a procedural mechanism that allows access to justice for the close relatives of the victim who died for reasons not related to the commission of a crime against him. The positions of procedural scientists involved in the study of this problem are analyzed, law enforcement practice is studied. The author suggests ways to solve the identified problem.
