A comparative analysis of the legal status of the male gender group is presented through an understanding of the historically established norms of customary law in the peasant environment in the second half of the XIX century. Using the historical method, the legal regulation of lynching and horse theft in villages of central Russia and Siberia during this period was studied in the aspect of analyzing the legal status of men. With the help of a retrospective analysis, such concepts as «customary law» and «lynching» are correlated through the prism of men's rights and duties.
