The marital and family relations of the founders of a family business directly affect the management of the corporation and, in the event of the departure of one of the founders from life, may lead to legal uncertainty and problems of law enforcement in the field of corporate rights for other participants in family business - spouses and other family members. Within the framework of this scientific article, the essential issues of inheritance of a share as a business asset to the surviving spouses in the framework of the implementation of the concept of family entrepreneurship, the realization of the rights of subjects of hereditary legal relations are determined. The necessity of ensuring a balance between the application of the norms of civil, corporate and family legislation in order to preserve the family business when transferring it to the surviving spouse within the framework of hereditary legal relations is determined.
