The theoretical aspects concerning the conceptual apparatus and the content of the circumstances that contributed to the commission of the crime are considered. The causes and conditions of the commission of crimes are correlated with the circumstances that contributed to the commission of the crime. The conclusion is proved that the circumstances under study are unambiguously included in the subject of evidence in a criminal case. It is established that the circumstances under consideration are subject to identification, proof and elimination. The author’s definition of the circumstances that contributed to the commission of the crime is given, which is formulated on the basis of a study of both theoretical aspects and taking into account the opinions of interviewed respondents represented by employees of the preliminary investigation authorities.
