The effectiveness of the application of Part 1 of the Article 314.1 of the Criminal Code of the Russian Federation is analyzed. To date, it is necessary to strengthen the interaction of the Ministry of Internal Affairs of Russia and the Federal Penitentiary Service of Russia at the level of issuing a joint order in order to prevent recidivism, to conduct preventive cases both during the term of serving a sentence and administrative supervision. Explanations of the delimitation of a crime and an administrative offense in relation to the sphere of administrative supervision are given, temporary criteria for the concept of «short-term departure» of a supervised person are considered.
