On the basis of the analysis of scientific literature and law enforcement practice the elemental structure of the criminalistic characteristic of the crime provided by article 304 of the Criminal Code of the Russian Federation, which differs from the traditional structure of the criminalistic characteristic of crimes in connection with the specificity of the considered criminal act, is determined. The features of each of the elements are analyzed. It is concluded that it is necessary to further improve the criminalistic characterization of the analyzed act, because, representing the orienting information, it allows on its basis to develop recommendations to improve the effectiveness of detection and investigation of bribe provocation and commercial bribery.
