The problems that the law enforcement officer encounters when investigating abuse of power in the financial and budgetary sphere are examined. It is noted that while carrying out a preliminary investigation, the law enforcement officer in accordance with Part 1 of Art. 144 of the Code of Criminal Procedure of the Russian Federation uses significant procedural and operational-search powers to establish signs of a crime that compensate for the problems of investigating abuse of official powers in the financial and budgetary sphere. The article analyzed the problems of the investigation and proposed ways to solve them.
