This article is devoted to the study of changes in legislation on the protection of personal data, which are aimed at strengthening constitutional guarantees of privacy. Personal data is considered as a key element of personal secrecy that requires special legal protection in the context of the digital transformation of society. The paper analyzes novelties in criminal law, in particular, the introduction of criminal liability for illegal actions with personal data - their use, transfer, collection, storage, as well as the creation and maintenance of information resources intended for their illegal dissemination. Particular attention is paid to distinguishing the types of crimes provided for in Art. 137 of the Criminal Code («Violation of privacy») and Art. 272.1 of the Criminal Code («Illegal use and (or) transfer, collection and (or) storage of compute information containing personal data, as well as the creation and (or) maintenance of information resources, intended for its illegal storage and (or) distribution»). The authors reveal the criteria for differentiating these norms, emphasizing that Art. 137 of the Criminal Code is aimed at protecting intangible assets related to a person's private life, Art. 272.1 of the Criminal Code is aimed at protecting the information security of computer systems and the integrity of personal data.
