The factors contributing to the latency of crimes in the field of bankruptcy have been revealed. It has been concluded that the main factor is the imperfection of the regulatory procedures for detecting signs of intentional or fictitious bankruptcy by arbitration managers. The self-regulation mechanism in the field of arbitration management is unable to ensure the development of a federal standard for arbitration managers to check for the presence or absence of signs of intentional or fictitious bankruptcy. There is a need for legislative revision of the degree of self-regulation in arbitration management, allowing for the development and approval of federal standards directly by the regulating authority. Recommendations have been formulated for investigators and those conducting inquiries regarding the verification of applications and the appointment of judicial economic examinations.
