The changes in civil law related to the modernization of the institute of bankruptcy of individuals of the Russian Federation as a result of the changes that occurred in 2023–2024 are considered. The analysis of the main innovations in the institute of bankruptcy of individuals has been carried out, the advantages in protecting citizens have been identified and problematic aspects regarding the insolvency of individuals have been identified, and approaches to changing the situation have been proposed. It is established that the procedure of out-of-court bankruptcy of individuals in 2023–2024 It was further developed and simplified, which, on the one hand, made it possible to expand the range of debtor applicants for the use of this procedure, thereby increasing the risks for creditors from the perspective of a possible increase in abuse and fraudulent actions on the part of unscrupulous debtor citizens. On the other hand, adopted in 2023–2024. Amendments to the legislation, as well as clarifications by the Supreme Court of the Russian Federation, partially balance the expansion of opportunities for recognizing the insolvency of an individual while minimizing possible abuses by the debtor and increasing the social protection of his family members.
