CURRENT ISSUES IN THE LEGAL REGULATION OF DIGITAL ASSETS: RISKS AND OPPORTUNITIES

Abstract:
It analyzes the current state of legal regulation of digital financial assets and digital currencies in the Russian Federation in the context of the rapid development of the fintech industry. A paradoxical situation is revealed ahead of the technological development of the pace of legislative regulation, which creates significant legal gaps and uncertainties for participants in the digital financial market. Particular attention is paid to conceptualizing the risks and opportunities of the current regulatory framework, including an analysis of the regulation of «hybrid» digital rights, digital currencies of central banks, stablecoins and unsecured cryptocurrencies. Key issues related to the mismatch between the actual digital financial relationship and its legal form are identified. Practical recommendations for improving legislation are proposed, including the creation of adaptive regulatory regimes that can flexibly respond to technological changes. The need to ensure a balance between stimulating innovative development and risk management in the interests of strengthening the economic security of the state is emphasized.
