Abstract:
The current problem of distinguishing between the evaluation of evidence on the merits of the charges brought and the assessment of circumstances considered when choosing a pretrial restraint measure in pretrial criminal proceedings is being examined. The author substantiates the thesis about the fundamental difference in the legal nature of these evaluative procedures. The paper criticizes the widespread law enforcement practice where the severity of the charged crime automatically leads to the selection of the most severe restraint measure without a proper analysis of the entire set of circumstances. The necessity of a thorough and motivated assessment of each of the circumstances specified in the law, in their systemic interrelation, with an emphasis on the analysis of the accused’s personality, family status, occupation, and state of health, is emphasized. It is concluded that only such an individual approach can ensure a balance between the interests of justice and the constitutional principle of personal inviolability.
