The article deals with the problem of differentiation of competence between arbitration courts and courts of general jurisdiction when considering disputes involving individual entrepreneurs. The specifics of the legal status of an individual entrepreneur as a subject combining the characteristics of an individual and an economic entity are noted. The key criteria for assigning a case to a particular jurisdiction category are analyzed, including the status of the parties, the nature of the legal relationship, and the purpose of the transaction. An overview of current judicial practice is provided, including the position of the Supreme Court of the Russian Federation.
