CIVIL PROCEDURE CODE OF THE RUSSIAN FEDERATION. WHAT'S WRONG WITH THE TITLE OF THE CODE?

Abstract:
The Civil Procedure Code of the Russian Federation, in force since 2003, has incorporated all the advantages and disadvantages of the mechanism of legal regulation of both intra-industry and inter-industry relations that are developing in society regarding the resolution of legally significant conflicts and disputes. A systemic disadvantage is the rejection of the principle of establishing objective truth in favor of procedural truth in a particular case. This is a clear example of the transition of legal science and practice to the rails of non-classical legal understanding, absolutizing multisystem (hybridity). Classification is a theoretical operation to divide the amount of knowledge about a subject based on system theory. The result of this operation (using animals as an example) is the assignment of an object to the concept of a kingdom, class, genus, species, subspecies, etc. With a lack of knowledge about the subject or a deficit in the subject of knowledge of mental abilities, classification based on system theory is impossible. Thus, some tribes of Melanesia still do not see a causal relationship between sexual intercourse and the birth of a child nine months after its completion. Law enforcers have greatly simplified the work with elements of the legal system by severely limiting the process of knowledge of the materials of the case accepted for proceedings - which a specific court has established on a specific dispute, that is, the truth. To do this, I had to block the principle of prejudice. As a result, the right space is gradually filled with decisions that have the force of law in cases according to which the same subject at the same time was in completely different places for the commission of various acts or acts. It is impossible to eliminate this drawback by making amendments and additions to the text, this will require the adoption of a new version of the code. In the medium term, when the number of conflicting judicial acts that do not meet the criteria for objective truth that have appeared in the absence of prejudice turns into quality, this will certainly be done. The new version of the legislative act will entail a change in its name, which will have to be brought in line with the constitutional norms and norms of the state language of the Russian Federation.
