ON THE METHODOLOGY OF RESEARCH ON PROHIBITION IN ADMINISTRATIVE AND TORT LAW

Abstract:
The article is devoted to the development of a comprehensive methodology for studying the category of prohibition in administrative and tort law. The article analyzes the dual (material and procedural) nature of administrative prohibition, its regulatory and protective functions, and its essential characteristics. The authors criticize the limitations of the traditional dogmatic approach and substantiates the need for an interdisciplinary methodological framework that integrates structural-dogmatic, functional-economic, socio-legal, and value-constitutional levels of analysis. The proposed model is illustrated using a case study of illegal entrepreneurship. The research results in a holistic methodological construct that allows for a comprehensive examination of the effectiveness, legitimacy, and constitutionality of administrative prohibitions.
